1. What This App Does

My Creative Stash (“the Service”) is a web application that helps crafters catalog and organize their supplies using AI-powered product recognition. The Service is operated by lic. Andreea-Iulia Bănțoiu, M., Vienna, Austria (“we”, “us”).

2. Your Account

• You must be at least 16 years old to use this service.
• You sign in via Google OAuth. You are responsible for maintaining the security of your Google account.
• One account per person. We may terminate duplicate or fraudulent accounts.
• You can delete your account at any time from your account settings.

3. Your Content

You own your content. Photos you upload and catalog data you create remain yours. By using the Service, you grant us a limited license to:

• Process your images through our AI pipeline to identify products
• Store your images on our CDN (Bunny.net) for display back to you
• Create database backups that include your data

This license exists solely to operate the Service and terminates when you delete your account. We will never sell, publicly display, or use your content for training AI models.

5. Acceptable Use

You agree not to:

• Upload illegal, abusive, or harmful content
• Use the Service to catalog stolen goods
• Attempt to reverse-engineer the AI pipeline or scrape data
• Abuse the recognition API (automated mass uploads, bots)
• Impersonate others or create misleading accounts
• Attempt to access other users' data

6. Service Availability

We aim to keep the Service running reliably, but we provide no uptime guarantee (no SLA). The Service may be temporarily unavailable for maintenance, updates, or unforeseen issues. We are not liable for any losses resulting from downtime.

7. Free & Paid Plans

The Service offers a free plan with monthly usage limits and one or more paid subscription plans with higher limits. Current plans and prices are shown on our pricing page and at checkout.

• Billing: Paid plans are billed in advance on a recurring basis (monthly or yearly) and renew automatically until cancelled. Payments are processed by Stripe.
• Cancellation: You can cancel anytime from your billing settings. You keep paid access until the end of the period you already paid for; we do not refund partial periods unless required by law.
• Price changes: We may change prices or plan limits with advance notice; changes apply from your next renewal.
• VAT: We operate under the Austrian small-business scheme (Kleinunternehmerregelung), so prices do not include VAT.

As a consumer in the EU you have a statutory 14-day right of withdrawal for digital services. By starting to use a paid plan immediately you agree that performance begins at once; once the service has been fully provided, the right of withdrawal expires in accordance with § 18 FAGG.

8. Limitation of Liability

To the maximum extent permitted by Austrian law:

• Our total liability is limited to the amount you paid us in the 12 months before the claim (which may be €0 for free-tier users).
• We are not liable for indirect, incidental, or consequential damages.
• We are not liable for AI misidentification of products or inaccurate price estimates.

This does not exclude liability for intentional misconduct or gross negligence, or any liability that cannot be excluded under Austrian consumer protection law (KSchG).

9. Termination

• By you: Delete your account anytime. All your data will be permanently removed.
• By us: We may suspend or terminate accounts that violate these terms, with notice where possible.

10. Governing Law & Jurisdiction

These terms are governed by Austrian law. For consumers resident in the EU, mandatory consumer protection laws of your country of residence also apply. Disputes shall be submitted to the competent courts in Vienna, Austria — without prejudice to your right to bring proceedings in your country of residence if you are a consumer.

11. Changes to These Terms

We may update these terms from time to time. Material changes will be communicated via the app. Continued use after changes constitutes acceptance. If you disagree, you may delete your account.
